To Enter
1. Entry to the STANIMA FANTASTY SPORTS OPEN CHAMPIONSHIP ("Contest")
takes place by Internet only. You must complete the registration and
entry form (an "Entrant") available at the Contest's website, www.STANIMA.com.
There is no limit to the number of entries by any one individual and
the number of prizes that may be won by an individual is not limited
in the Contest. Shared team ownership, however, is not permitted.
Fees, charges and costs for Internet entries are paid using MasterCard,
VISA®, American Express, or PayPal™ via the PayPal™ web interface
and must be paid, received and accepted by 9 PM CT, Wednesday, September
3, 2014. Please note: The last day and time to register is 9 PM CT,
Wednesday, September 3, 2014, and the last draft time is 10 PM CT,
Wednesday, September 3, 2014.
A. The cost to play is $55 per STANIMA FANTASY SPORTS OPEN CHAMPIONSHIP
Tier 1 team and $110 per STANIMA FANTASTY SPORTS OPEN CHAMPIONSHIP
Tier 2 team for teams drafting from April 20, 2013, through 10 PM
CT on September 4, 2013. There are 2 Tier options available:
1.1 The Tier 1 Team - The total cost is $55.
1.2. The Tier 2 Team - The total cost
is $110.
Your Eligibility
You must be 18 years of age or older at the time of registration to enter the Contest. PLEASE NOTE: This Contest is open to legal residents in a jurisdiction in which the contest is permitted by law. Residents that live in the states or anywhere else where the contest is prohibited or regulated by law are not permitted to enter, these states include Arizona, Montana, Maryland, Lousiana, Vermont and the Canadian province of Quebec. Employees and immediate family members of For Stanima LLC are not eligible to win awards. All players must have Internet access to help manage their team throughout the duration of the contest. The STANIMA FANTASTY SPORTS OPEN CHAMPIONSHIP may (at its discretion) deny eligibility of any entrant to participate in the event. Under no condition shall Stanima LLC be held responsible for any loss or liability related to any expenses incurred by a denied entrant or anybody else affiliated with that denied entrant.
GAME OF SKILL: This Contest is a game of skill. Prize winners are determined by the objective criteria listed below, rules, scores, and by the skill and knowledge of each Entrant using accurate and timely real-world data from authoritative sources. This contest will test a participant's ability to predict player performance both over time and on a weekly basis, as well as to value certain players and positions within the framework of our scoring system, place appropriate bids on free agents based on the relative future value to the entrant's team, and create a balanced fantasy team that will maximize scoring output over the length of the season.
TERM: This Contest begins with the football game on Thursday, September
4, 2014, and ends on Monday, December 22, 2014, spanning Weeks 1 through
16 of the pro-football season in the United States. THIS CONTEST IS
VOID WHERE PROHIBITED.
Prizes
1. At the end of the STANIMA FANTASTY SPORTS OPEN CHAMPIONSHIP Contest, subject to the rules and eligibility requirements, prizes are awarded to the top teams in the Open, Next and Last Brackets and to the top (1) top team in each league as stated below in the prize table. Prizes are guaranteed. Prizes may increase as the contests grows, but will never decrease. Prizes are not based on any math formula, nor are they contingent on total money collected or number of entries.

2. Each Tier 2 league winner receives $195. Each Tier 1 league winner
receives $75. Complete scoring details are available at www.stanima.com/football/rules.
Notification
Cash prizes are awarded in U.S. Dollars to one individual per team.
The 8Open Bracket cash prizes, 3Next Bracket prizes, 3 Last Bracket
prizes, and 5 J Bracket prizes cash prizes will be awarded on Thursday,
January 15th, 2015, provided that each potential prize winner completes
and signs his or her affidavit of eligibility, publicity/liability/talent
release (except where prohibited by law), tax forms, and other documents.
Failure to comply with this requirement can result in disqualification
or extend the time it takes to receive his or her prize. Any prize
notification returned as undeliverable may result in disqualification
and selection of an alternate winner. After 12 months, any unclaimed
prize is forfeited. The potential prize winner(s) are required to
sign and return, within 15 days of issuance, the affidavit of eligibility,
publicity/liability release, except where prohibited by law, and tax
forms. The failure to return such documents within the specified time
period, noncompliance with these rules, the return of any prize or
prize notification or if any potential prize winner declines a prize
may disqualify that prize winner and an alternate eligible Entrant
with the next highest score will become the potential prize winner.
Except where prohibited by law, winner's acceptance of a prize constitutes
permission for the Contest Entities to use prize winner's name, photograph,
likeness, statements, biographical information, voice, and address
(city and state) worldwide and in all forms of media, in perpetuity,
without further compensation. In the event of a dispute, entries made
by Internet will be declared made by the authorized account holder
of the e-mail address submitted at time of entry. "Authorized account
holder" is defined as the natural person who is assigned to an e-mail
address by an Internet access provider, on-line service provider or
other organization (e.g., business, educational institution, etc.)
that is responsible for assigning e-mail addresses for the domain
associated with the submitted e-mail address. Contest Entities reserve
the right, at their sole discretion, to disqualify any individual
who tampers with the entry process (by computer virus, bugs, tampering,
unauthorized intervention, fraud, technical failures, or any other
causes beyond the control of Contest Entities which corrupt or affect
the administration, security, fairness, integrity, or proper conduct
of this Contest), and to cancel, terminate, modify or suspend the
Contest. In such event, Contest Entities reserve the right to award
prizes to the eligible Entrants with the most points as of the termination
date and to award the prize(s) to eligible Contest Entrants as measured
by the best record (tie breakers rules will apply) in each league
in the Contest as of termination date.
Entries
The Contest Entities are not responsible for and you forever waive your right to any claim against Contest Entities: a) in connection with, lost, late, incomplete, corrupted, stolen, misdirected, illegible, incomplete or postage due, entries, entrant information and affidavits; b) for any computer, telephone, cable, network, satellite, electronic or Internet hardware or software malfunctions, or unauthorized human intervention including theft or destruction or unauthorized access to, alteration of, or failure to capture the entry, entries or transactions; or c) failure of any e-mail entry or transaction to be received on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading any materials from this Contest.
Internet. If for any reason the Internet portion of the program is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the reasonable control of Contest Entities and which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, Contest Entities reserve its right to cancel, terminate, modify or suspend the Contest. In such event, Contest Entities further reserve its right to award prize(s) to Entrants/potential prize winners with the most points as of the termination date and to award the prize(s) to eligible Contest Entrants as measured by the best record (tie breakers rules will apply) in each league in the Contest as of termination date.
Entries. Contest Entities are not responsible for lost, late or misdirected on-line entries or transactions, for incorrect, inaccurate or incomplete entry information whether caused by a contestant, equipment, or technical malfunction or for any human error, technical error or malfunctions. Contest Entities reserve the right to halt or modify the Contest at any time during the Contest period if events beyond their reasonable control, compromise the Contest's fairness or integrity. In the event that a scheduled football game is canceled or preempted for any reason, no points will be awarded for that week for players on those NFL teams. Contest Entities are not responsible for typographical or other human or technical errors in the offer or administration of this Contest, including but not limited to errors in advertising, the Official Rules, the selection and announcement of the prize winner(s) or the distribution of prizes. . Stanima, LLC may cancel the event due to any acts of God, natural disasters, terrorism, change in applicable law, interruption in the NFL season (including strikes, lockouts and/or use of replacement players), failure or ceasing of operations by our fantasy league data host, Hawkhost.com, or failure to get the minimum number of intended registered participants.
Conduct. Contest Entities, in their sole discretion, may disqualify any Entrant from participating in the Contest, refuse to award points or prize(s), and require the return of prize(s), if Entrant engages in any conduct Contest Entities deem improper, unfair or otherwise adverse to the operation of the Contest or detrimental to other Entrants. Such improper conduct includes, but is not limited to, falsifying personal information required during Contest registration or prize claim(s), violating any term or condition stated herein, accumulating points or prizes through methods such as automated computer scripts or other programming techniques, allowing others to use the Entrant's personal information for the purpose of accumulating points or prize(s), tampering with Contest Entities' administration of this Contest, or intentionally trying to defraud, reverse engineer, disassemble, decompile or otherwise tamper with the computer programs on this website. Entrant further acknowledges that the forfeiture of any prize(s) and/or return of the prize(s) shall in no way prevent Contest Entities from instituting or assisting in the institution of other avenues of recourse such as criminal or civil proceedings in connection with such conduct.
Any participants who collude, or attempt to collude, in an effort
to alter the standings, rankings, or fantasy point totals will be
disqualified and be prohibited from winning any award money. In addition,
any participant that alone attempts to sabotage the results of the
league by not giving equal effort against all competitors will be
disqualified and prohibited from winning an award. At the sole discretion
of Stanima LLC, in any of these above circumstances, the colluding
or sabotaging owner's team may be taken over by a surrogate or agent
of Stanima, LLC, or be frozen by Stanima LLC for the remainder of
the season. This rule also applies to any participant that attempts
to blackmail, bribe, coerce or otherwise influence any officers or
agents of Stanima, LLC in an effort to alter the standings, rankings,
or fantasy point totals. Any participant that does this will be prohibited
from winning any award money and will further have his or her team
taken over by a surrogate or agent of Stanima, LLC. Any criminal behavior
by a participant which attempts to corrupt or alter the fairness of
Stanima may result in civil and/or criminal prosecution. Any attempt
made to purposely damage or affect the web site, or to undermine the
operation of this contest is a violation of civil and criminal law.
Stanima, LLC reserves the right to seek damages and full criminal
prosecution as permitted by law.
Participants are expected field a starting lineup on a weekly basis
and to manage their team to the best of their ability for the duration
of the STANIMA season. We understand that some teams will stop actively
managing their teams and may abandon them during the regular season.
Stanima, LLC cannot manage abandoned teams and is not able to start
and bench players for those teams. If Stanima, LLC believes that any
team has been abandoned, Stanima, LLC reserves the right at its sole
discretion to either appoint a surrogate owner, or to freeze a team's
roster for the remainder of the season. Entrants recognize that in
many cases, it will be most feasible for Stanima, LLC to opt for the
freezing solution, albeit this result is sometimes imperfect. Participants
assume this risk when entering the contest. Stanima, LLC reserves
the right to intervene in team management of any team whose participant
is willingly trying to field a less competitive team or is manipulating
the contest.
Virus. Contest Entities reserve the right to disqualify any individual who tampers with the entry process and to cancel, terminate, modify or suspend the Contest for any reason including, but not limited to, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other reason corrupting or affecting the administration, planning, security, fairness, integrity or proper conduct of the Contest. ANY ATTEMPT BY A PARTICIPANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, ENTRANT SHALL BE EXPELLED AND CONTEST ENTITIES RESERVE THEIR RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW.
Contest Errors
The Contest Entities assume no liability and are not responsible for, and you hereby forever waive any rights to any claim in connection with, errors and/or ambiguity: a) in the Contest; b) in any related advertising or promotions of this Contest; and/or c) in these Official Rules including but not limited to errors, the selection and announcement of a prize winner or the distribution of a prize. In the event of any ambiguity or error(s) in these Official Rules, Contest Entities reserve the right to modify these Official Rules for clarification purposes or to correct any such ambiguity or error(s) without materially affecting the terms and conditions of the Contest.
Refund Policy
To withdraw your team and receive a full refund of your entry fee, you must submit your request before your 10-team league assignment and corresponding draft date and time have been confirmed. All requests must be received in writing. Please allow 30 days to receive your refund check. Once your 10-team league assignment and corresponding draft date and time have been confirmed, the league is locked and no refund will be issued.
At its sole discretion, Contest Entities reserves their right to terminate
the Contest in its entirety in the event there are an insufficient
number of Entrants and their teams by August 28, 2014. Upon occurrence
of this event Combined Entities may refund Entrant's entry fees within
48 hours of the Contest's termination and cancel the Event or send
Entrant a new entry form with newly stated prize amounts, dates, etc.
This section is subject to the Release, Indemnity and Limitation of
Liability sections below. For clarification, an Entrant's own travel
or hotel expenses or his or her time taken off from employment are
the sole responsibility of Entrant.
Official Rules
This Contest is subject to the laws of the United States and to the Official Rules, and no part of this Contest may be used in connection with any form of gambling. This is a skill Contest designed to increase consumer awareness of and interest in the Contest Entities and all aspects of the game of football and in particular, professional football. By entering the Contest, you agree to abide by the terms of the Official Rules and by the decisions of the Contest Entities, which are final on all matters pertaining to the Contest. The Official Rules are the rules posted on the Contest's website. In the event that the Contest is challenged by any legal or regulatory authority, Contest Entities reserve the right to discontinue or modify the Contest, or to disqualify participants residing in the affected geographic areas. In such event, Contest Entities shall have no liability to Entrants who are disqualified due to such an action.
Release, Indemnity and Limitation of Liability
Each entrant in the Contest, including, without limitation, the prize winners release and agree to hold harmless the Contest Entities from any and all liability for any injuries, loss or damage of any kind to person, including death, and property, arising in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of a prize, participation in this Contest and participation in any activity related to this Contest. By participating in the Contest, Entrants release and agree to hold harmless Contest Entities, their directors, officers, employees and agents from any liability whatsoever for any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Contest (including, without limitation, claims, costs, injuries and losses related to personal injuries, death, damage to or destruction of property, right of publicity and privacy, defamation or portrayal in a false light, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory. All participants agree to abide by the terms of these Official Rules and the disclaimers and by the decisions of Contest Entities, which are final and binding on all matters pertaining to the Contest. Contest Entities are solely responsible for enacting, administering, enforcing the rules, and maintaining the integrity of the Contest and reserve the right to review and arbitrate all league drafts and all roster changes, including blind bid and first-come-first-served free agent acquisitions, in order to uphold the integrity of the Contest and prevent collusion and reserve the right to cancel any league that they determine, in their sole discretion, exhibits collusion during the draft and/or during any point during the Contest period. The Contest and website are not sponsored or endorsed by the National Football League. The Contest Entities assume no liability and are not responsible for, and you forever waive any rights to any claim in connection with, the selection and announcement of a prize winner, the distribution of a prize, the acceptance/possession and/or use/misuse of any part of a prize and/or any injury or damage to any Entrant's or a third person's property related to or resulting from any part of a prize or any part of this Contest.
IN NO EVENT WILL THE CONTEST ENTITIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO AND USE OF THE SERVICE AND/OR THE CONTEST, DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM THE SERVICE AND/OR THE CONTEST. IN NO EVENT SHALL CONTEST ENTITIES' TOTAL LIABILITY TO YOU FOR DAMAGES, LOSSES, OR FROM A CLAIM EXCEED $100.00. WITHOUT LIMITING THE FOREGOING, EVERYTHING IN THE CONTEST AND THE SERVICE INCLUDING THE PRIZES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSIONS OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES SO THAT SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU.
Binding Arbitration, Governing Law and Jurisdiction
The parties waive all rights to trial in any action or proceeding instituted in connection with these Official Rules, including, without limitation, the Contest. Any controversy or claim arising out of or relating to these Official Rules and/or the Contest shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted in Austin, Texas. THESE OFFICIAL RULES AND THE INTERPRETATION OF ITS TERMS SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF TEXAS WITHOUT REGARD TO ITS CONFLICTS OF LAWS RULES. For any matters which are not subject to arbitration as set forth in these Official Rules and/or in connection with the entering of any judgment on an arbitration award in connection with these Official Rules and/or the Contest, the parties irrevocably submit and consent to the exclusive jurisdiction and venue of Texas and federal courts located in Austin, Texas. The parties agree not to raise the defense of forum non conveniens.
